What civil rights are protected under Idaho law?
Idaho law prohibits discrimination in employment, education, real estate transactions and public accommodations. Illegal discrimination may be based on race, sex, color, national origin, religion, age (40 and older) and disability.
What can the IHRC do about discrimination?
Mediation: Mediation services are available at little or no cost. About 20% of the cases are settled on this “no-fault” basis. This is an opportunity for parties to settle a dispute on their own terms.
No Cause Findings: If the available evidence does not suggest that illegal discrimination occurred, the case is dismissed. Both parties will receive a report explaining the basis of this finding.
Probable Cause Findings: If the evidence suggests that discrimination did occur, the report will explain that conclusion. The IHRC will work for a resolution that will compensate the victim for the harm he or she suffered and help assure that others will not receive similar treatment from that organization in the future. If a conciliation agreement is reached, the parties and the IHRC agree the dispute is closed.
Litigation: If the parties and the IHRC cannot agree on a resolution, the IHRC may decide to file an action in district court on behalf of the injured party. The IHRC has one year from the date an administrative complaint is filed in which to file an action in court. Individuals have (90) ninety days from the IHRC’s dismissal of an administrative complaint to file a private action in courtc
